Latest changes to NDIS Legislation from 3 October 2024
The NDIS has recently announced updates of what is and what is not considered an NDIS Support. You can download the information below:
Self-management changes
Impairment Notice
From 1 January 2025, new participants will get a Notice of Impairment to confirm they have a permanent disability or significant impairment that meets the NDIS disability and/or early intervention requirements. The Notice of Impairment will state the category or categories of impairment the participant has.
It responds to recommendations from the NDIS Review and requests from participants to recognise that people with disability who have the same diagnosis may have different impairments and support needs.
There are 6 impairment categories:
- Intellectual
- Cognitive
- Sensory
- Neurological
- Physical
- Impairments relating to a psychosocial disability.
Note: For children younger than 6 years old who meet the criteria for developmental delay, the information will say they are eligible under the early intervention requirements with developmental delay.
Yes … Your impairment notice may include one or more of impairment categories. For example, you might have both physical and sensory impairments and require discrete supports for each.
- Nothing for now.
- You’ll receive your impairment notice when transitioning to a new plan or during your next review. The NDIS should work with you to make sure they have the information they need ahead of any changes.
- If you think your impairment notice is wrong, you or your plan nominee can request a variation, like adding or removing impairments, this can be actioned at any time. You’ll simply need to provide information to support your request which will depend on why the change is needed.
- If the NDIA changes your impairment category/categories, they will update this in your NDIS records.
- If you don’t agree with the NDIA’s decision, you can ask for a review of the decision.
